Terms and Conditions

    1. This reservation confirmation is entered into as of this date by and between Gulfcoast Holiday Homes & Real Estate LLC (hereinafter referred to as “GCHH”), whose address is 1900 Main Street, Suite 200, Sarasota FL 34236, and the resident (hereinafter referred to as “Client” or “Guest”), at the Vacation Rental Home or Vacation Rental Accommodation  (hereinafter referred to as “Accommodation” or “Property”) written and the dates indicated. Client agrees to rent the accommodation from GCHH for the entire term as specified under item # 8 below.
    2. Guest agrees that he/she (and any occupant or invitee) will abide by these Terms and Conditions and all rules and regulations of the Property. GCHH and/or the building management reserve the right to remove any guest due to misconduct or violation of these Terms and Conditions or such rules and regulations.
    3. GCHH reserves the right to inspect, repair, remodel, and maintain any accommodation, with advance notice given whenever possible. If the property should go on the MARKET FOR SALE, it may be shown to qualified buyers during the Guests stay.  Every effort will be made to schedule the showing at a convenient time and not interrupt the Tenant’s vacation. Tenant shall allow reasonable viewings of the home between 10 am and 6 pm present or not. GCHH will give 24 hours advance notice so guest can prepare and will try to coordinate.
    4. Pets are permitted in specific accommodations only if GCHH gives Guest prior written approval of the specific pet (any additional or different pets will require separate written approval), and Guest complies with the following terms: (a) Guest must abide by all property restrictions and rules regarding pets at all times; (b) Guest must pay to GCHH a non-refundable pet fee to be determined prior to move-in; (c) Guest is responsible for any damages to the Accommodation  and common areas of the Property; (d) Guest must manage their pets, including immediately cleaning up after them in the Accommodation  and common areas of the Property; (e) Pets are not permitted in the garage or parking area; (f) excessive noise will not be allowed; and (g) Guests must confine pets during periods when GCHH employees are scheduled to visit. Guests may be asked to remove the pet from the Property if there are any violations of these rules. GCHH may terminate the reservation with respect to any Guest that refuses to comply with such request. Any pet damage to the Accommodation upon departure will be accessed and the resident will be responsible. This includes but not limited to the flooring wood/carpet, entire bathroom, all furniture, baseboards, paint, all linens, complete kitchen, complete bedrooms, and any other pet damage found inside the Accommodation. This includes all inventory GCHH items in the Accommodation upon arrival. Repairs required to rectify the damage will be restored for new or refurbished; whichever is least costly to place the Accommodation back to the arrival condition.
    5. Guest will be liable for payment for loss of keys, gate passes, garage door opener (charges incurred for items if not returned within 24 hours after departure date), or for any damages to the Accommodation and its furnishings or fixtures or the common areas of the Property due to negligence, neglect or abuse of Guest, any occupant or invitee (including any extra cleaning or repairs required, in GCHH‘s discretion). Monthly rent is charged on a thirty – (30) day billing cycle. Move-out cleaning fee – Guest shall be responsible for a cleaning fee as specified in the booking and charged up front. The contents of the Accommodation have been inventoried prior to your arrival and will be inventoried upon your departure. Guest will be charged for items that are lost or missing. Guest is required to make a fully refundable security deposit of 300 USD at check-in or arrival in the form of a credit card imprint, to cover the cost or parts of the cost in the event a damage to the Accommodation.
    6. The Guest agrees to take good care of the Accommodation and not to perform any hazardous, offensive or unlawful activity in the Accommodation or the common areas of the Property. The Guest agrees to obtain and/or maintain its own insurance and/or be responsible for the personal belongings of Guest, any occupant or invites. Guest agrees and acknowledges that GCHH will not be responsible for the safe-keeping of equipment, supplies, written material or other valuable items left in apartments or common areas of the Property. Guest may not rely on any contrary verbal or written assurances provided by GCHH staff in this respect. Florida State/Provincial laws will govern GCHH liability for items stolen from Accommodation.
    7. The Guest will defend, indemnify and hold GCHH harmless for any claims, losses or expenses arising from Guest’s, any occupant’s or invitee’s use of the Accommodation or the common areas of the Property.
    8. The term of this agreement shall be based on the Check-in Date to the Check-out Date, as well as any extensions beyond the original Departure Date. Rate of extensions to the original departure is subject to review.
    9. Any extension of the departure date is subject to availability and approval by GCHH. Any UNAUTHORIZED occupancy beyond Check-out dates AND especially Check-out Time on Check-out date, not approved by GCHH will be liable for a charge of four (4X) the daily, weekly or monthly rates then in effect for such holdover. Additionally, the occupant will be responsible for all costs incurred by GCHH to reschedule our vendors to come back to that Accommodation plus hotel costs incurred for incoming guest.
    10. Rate charges and applicable taxes are due and payable in advance. 25% of the rent is payable within 5 days after the booking as a non-refundable deposit. The balance of the rent is payable 30 days before the check-in date. Guest agrees to pay GCHH all fees and costs, including reasonable fees by attorneys or collection agencies, incurred in GCHH efforts to collect all amounts due.
    11. Pool heat: Pool heat is an optional amenity at most properties managed by GCHH. Pool heat can be added to a reservation for a nightly rate that varies depending on the villa that is reserved. There is a minimum of 7 nights for pool heating, unless confirmed otherwise by GCHH.  Once pool heat is requested by the guest, the heater is turned on 24 hours prior to a guest check in date and will run from approximately 9AM to 6PM for the dates that have been paid for. Pool heaters will warm the pool to between 70 and 85 degrees Fahrenheit when operating optimally. Electric heating pumps, while still operating, are not effective during cold weather days when the outside ambient temperature drops below 60 degrees Fahrenheit. Refunds will not be granted when pool heaters fail to operate effectively due to an act of nature.
    12. Cancellation Policy: All rental payments (less cleaning fees, pool heating fees or any additional service fees) other than the non-refundable deposit are fully refundable up until 45 days prior to the day of arrival. If GCHH should be able to rebook the property, the guest will be refunded all rental payments made up to the amount, that could be recovered by the new booking.
    13. Guest may not assign, sublease, transfer the Reservation Confirmation, the Accommodation or any part thereof or permit the use of the Accommodation by anyone other than the Guest and permitted occupants.
    14. Guest represents, warrants and covenants to GCHH that Guest’s use and occupancy of the Accommodation is of a transient nature and the Accommodation is not intended to be a permanent residence of Guest. In no event shall Guest’s occupancy and use of the Accommodation be construed to create any landlord/tenant relationship between GCHH and Guest. This Agreement is not a lease and is not intended to convey to Guest any real property interest or estate in or to the Accommodation or any other portion of the Property.
    15. Do not park in any garage or covered parking space unless specified. Parking violations and towing expenses for improperly parked cars are the responsibility of the Guest. Parking may or may not require a parking tag, garage opener, or access card, review your Welcome Letter for instructions.
